New ITR Forms(ITR 1 & ITR 4) Notified for AY 2020-21: Key Changes

The Income Tax Department now allows the filing of ITR-1 and ITR-4 for the FY 2019-20 (AY 2020-21) by
- Joint Owners of a house property
- The person falling under 7th proviso to section 139 i.e.
Having electricity expenditure in the year exceeding Rs 1Lakh
Depositing in the current account(s) cash exceeding Rs 1 cr
Incurring expenditure in foreign travel for self or others exceeding Rs 2Lakhs
The pronouncement has been made by the tax department vide its press release dated 09th Jan 2020.
To everyone’s surprise the new income tax return forms for FY 2019-20 (AY 2020-21) have been notified by the income tax department on 3rd Jan 2020. To begin with, CBDT (Central Board of Direct Taxes) for the time being has notified ITR 1 and ITR 4. However, the detailed instructions on these forms and their excel and java utilities are yet to be released.
Additional Disclosures in ITR 1 and ITR 4 for AY 2020-21
Following are the ADDITIONAL DISCLOSURES you need to make while filing form ITR 1(SAHAJ) and ITR 4 (SUGAM) for the AY 2020-21(FY 2019-20):
- Passport Details: In case you have a valid Indian Passport. Details of the same need to be provided.
- Electricity bill exceeding Rs 1 Lakh:
If in the financial year you have incurred an aggregate expenditure exceeding Rs 1 lakh then you are required to state the details while furnishing your income tax return.
- Deposit exceeding Rs 1cr:
In case you have deposited an aggregate amount exceeding Rs 1 cr in the financial year 2019-20 in any of your current accounts then the same needs to be reported at the time of filing ITR 4.
- Foreign Travel Exceeding Rs 2 Lakh:
If you have done or sponsored any foreign travel, exceeding Rs 2 lakh in the FY 2019-20 then disclosure of the same is required while filing ITR 4 for the AY 2020-21.
- Cash and Bank Details
In case of presumptive business, the cash and bank transaction details are also required to be stated.
Key Changes in the ITR form for AY 2020-21
Apart from the additional disclosures stated above there have been a major change in the list of eligible taxpayers who can furnish ITR 1 and ITR 4.
- Joint Owners of a house property :
Unlike the previous years, ITR forms 1 & 4 are no longer available for filing by the JOINT OWNERS of a house property. Even if you have one house property you cannot opt to fill either of the two forms i.e neither ITR 1 nor ITR 4 if the case of co-ownership exists, for the AY 2020-21.
Issuing of the new ITR 1 and ITR 4 forms by the tax department way before the expected time will enable the taxpayers to gather the requisite information on a timely basis and have reduced the grounds for the due date to get extended. The remaining ITR forms and ITR filing utilities can also be expected soon.
